2. User Guide: General Terms and Conditions of usage of the FEDORA Platform

2.1. General Information

Voting phase during the FEDORA Prizes Competition

The voting phase on the FEDORA Platform takes place every year. During this period, anyone can discover the shortlisted projects for the FEDORA Prizes on the FEDORA Platform and can vote online for their favourite projects. Each registered user can attribute one vote to each project.

Donation phase during the FEDORA Prizes Competition

The donation phase on the FEDORA Platform takes place every year. During this fundraising phase anyone can discover the nominated projects for the FEDORA Prizes on the FEDORA Platform and can donate to their favourite projects. A donor can make multiple donations to any nominated project on the FEDORA Platform, but the benefits provided by the nominee cannot be accumulated per project. Individuals and companies based in France, selected European countries and the USA have the opportunity to receive a tax receipt for their donation. This option excludes the possibility to receive benefits offered by the projects.

Becoming a member of FEDORA or donating to FEDORA

Throughout the year, any individual or company can make a donation to FEDORA or register to become a member on the FEDORA Platform to support FEDORA’s activities.
Individuals and companies based in France, selected European countries and the USA have the opportunity to receive a tax receipt for their donation.

2.2. Technical information about registering and donating online on the FEDORA Platform

User online registration

In order to vote online, platform users need to register on the FEDORA Platform with their email address or with their Facebook account. The user receives a verification email to his or her registered email address in order to activate his or her account on the FEDORA Platform. Disposable email addresses are not accepted for registrations on the FEDORA Platform. This is done to guarantee the rightful procedure of the voting process so that no fake email accounts can be used and to avoid that email addresses are used without the permission of their legal owner.

Donor online registration

While donating online on the FEDORA Platform, donors have the possibility to set-up an account on the FEDORA Platform with their email address. If they do so, the user receives a verification email to his or her registered email address in order to activate his or her account on the FEDORA Platform.

Payment methods and currency

Donations and membership payments can be made online by credit card. The FEDORA Platform accepts Visa Card and Mastercard. Payments are made in euros on the FEDORA Platform. The FEDORA Platform guarantees for a secure payment procedure for the credit card transactions on the FEDORA Platform.

Tax deductible donations for French fiscal residents and companies

The FEDORA Platform provides donors who are French fiscal residents and companies registered in France with tax receipts corresponding to the amount of their donation following French fiscal law. In order to provide the tax receipts, donors need to provide their full name and address. For international legal coordination purposes, a donor who chooses to benefit from tax deduction cannot additionally obtain the crowdfunding benefits associated to the donation basket he or she selected in the context of the fundraising campaigns of the nominated projects.

Tax deductible donations for individuals and companies based in selected EU countries

Residents from and companies registered in Belgium, Bulgaria, Croatia, Germany, Greece, Hungary, Italy, Spain, Switzerland or U.K. can benefit from tax deductions valid in their country of residence. To do so, the donor will be redirected to the Transnational Giving Europe Platform to proceed to the payment of its donation. To this end, Transnational Giving Europe will use and collect the donor’s data as explained in their Privacy Statement.

Donation transactions are made in each country’s local currency of the above-mentioned countries.

Donations can be made online by Visa, Mastercard, Maestro, Bancontact or Paypal, depending on each National Transnational Giving Europe Partner Foundation’s capacity. Transnational Giving Europe guarantees a secure payment procedure through the Transnational Giving Europe Platform powered by iRaiser.

The National Transnational Giving Europe Partner Foundation is responsible for emitting a valid tax receipt according to donor’s country of tax residence, after having conducted a due diligence verification procedure required by national laws.

Information that is shared with nominees and their collaborators

Once a donor makes a donation to a project on the FEDORA Platform or on the Transnational Giving Europe Platform, the FEDORA Platform informs the project’s lead company about the donor’s name, donation amount, and the selected benefits. Projects never receive donors’ credit card details or other payment information. At the end of the fundraising campaign, the projects will coordinate directly with the donor the delivery of the benefits (if applicable) and updates about the advancements of the project.

FEDORA commits to transferring the donations received on behalf of the nominated projects minus its management fees (6% for donations processed through the FEDORA Platform and 14% for donations processed through the TGE Platform) to the project after the end of the nominees’ fundraising campaigns.

The lead companies have the option to appoint collaborators to help manage their project. These collaborators may be able to access some of the information available to the project (including donors’ names, email addresses, donation amounts, benefit selections and messages), and are required to treat donors’ personal information with the same care and respect as the lead companies are. The lead‐companies and their collaborators may also receive anonymized information about the ways people visit and interact with their project page, in the form of routine traffic analytics.

3. Privacy Policy

Protecting your information and being transparent about how we use it, is one of the core commitments we make to you. Pursuant to the data protection legislation in force, we hereby inform you that the data you have furnished, including any information data arising from your donation transaction, and any other information furnished by you when browsing the Website, shall be included in one or more files owned by FEDORA, with registered office in Palais Garnier, 8 rue Scribe, 75009 Paris, France.

3.1. What information we collect

In order for you to create an account on the FEDORA Platform and use our Services, we need to collect and process some information. Depending on your use of the Services, that may include:

  • Information that you provide by completing forms on the FEDORA Platform — your name, email and postal addresses, telephone number, country of residence, date of birth, login, and password details. We will ask for the information if you register as a user of the Services, subscribe to our newsletters, subscribe as a member of FEDORA, make a donation or request any information;
  • Details of any requests or transactions you make through the Services. All payment information you submit is collected and used by our payment processors in accordance with their privacy policies. The FEDORA Platform does not store your payment information;
  • Information about your activity on and interaction with the FEDORA Platform (such as your IP address, the type of device or browser you use, and your actions on the site); and
  • Communications you send to us (for example, when you ask for support, send us questions or comments, or report a problem).

3.2. How we use this information

We use the information we collect for the following purposes:

  • To keep your account secure;
  • To enable us to provide you with our Services, and to improve, promote, and protect our Services;
  • To set up and administer your account, contact you;
  • To track use of the Services so that we can improve the FEDORA Platform;
  • To prepare statistics;
  • To manage the registration and deregistration of users;
  • To issue tax receipts (if applicable);
  • To organise services and coordinate benefits;
  • To prepare user satisfaction surveys;
  • To send newsletters;
  • To offer services;
  • To customise subsequent browsing;
  • To send marketing communications.

3.3. Information that is not shared publicly

The following data will not be publicly displayed or revealed to other users:

  • Any payment information you provide;
  • Your password details;
  • Your IP address;
  • Your phone number; and
  • Communications you send to us (for example, when you ask for support, send us questions or comments, or report a problem).

We never post anything to your Facebook or other third‐party accounts without your permission. We do not and will not sell your data.

3.4. Information that is shared with trusted third-party services

We may share your information with certain trusted third-party services to help us provide, improve, promote, or protect the FEDORA Platform’s Services (like when we partner with payment processors, or use services that help us manage our ads on other sites). When we share data with third-party services that support our delivery of the FEDORA Platform Services, we require that they use your information only for the purposes we’ve authorized, and that they protect your personal information at least to the same standards we do. For reporting reasons, we may also share information that’s aggregated and anonymized in a way that it doesn’t directly identify you.

3.5. Access to your information

In accordance with the French Data Protection Law, Act n°78‐17 of 6 January 1978 on Information Technologies, Data Files and Civil Liberties, we inform you that you have a right at any time to access, modify or delete your personal data within FEDORA and the right to object for legitimate reasons. To modify or delete the personal information you’ve provided to us, please log in and update your profile. We may retain certain information as required by law or for necessary business purposes.

3.6. Quality and conservation of the data collected

FEDORA undertakes to act in accordance with the data quality principle, conserving and using the information furnished by you, provided that such use and conservation is justified by the fulfilment of the purpose for which such information was collected, and in those cases provided for in legislation in force.

Furthermore, you hereby undertake to notify FEDORA of any change to your personal data to ensure that it remains up-to-date at all times and contains no errors. If you furnish us with the personal data of other individuals, we hereby warn you that you must do so with their consent, having notified them beforehand of the matters contained in this document. The User guarantees that the personal data provided are true and accurate, and undertakes to notify any changes or modifications thereof. In the event that we are provided with personal data pertaining to third parties, the User is responsible for having informed and obtained the latter’s consent for the said data to be used for the purposes indicated in the corresponding sections of this Privacy and Cookies Policy. Any loss or damage caused to the Platform, data controllers or any third party through the communication of incorrect, inaccurate or incomplete information in the registration forms shall be the sole responsibility of the User.

3.7. Security measures

FEDORA hereby states that it has adopted all the security measures required to ensure the integrity, security and conservation of the Personal Data stored in its files, in accordance with the provisions of the legislation in force in relation to data protection, and recognizes and appreciates the importance of responsible use of such information.

4. Cookies

4.1. What are cookies?

Cookies are small text files that are placed on your computer by the websites you visit. They are widely used to ensure that the Website functions correctly and efficiently since they provide the owners of the Website with information. The use of cookies is standardised in the majority of websites.

4.2. Use of cookies by FEDORA

Cookie use on the Website, in accordance with the guidelines of the French data protection agency, is as follows: By using the Website, we understand that you consent to, and agree with the use and storage of cookies on your computer/device/browser for the purposes stated above. 5. Liability

5.1 Limitation of responsibility

FEDORA is not responsible for any damage to computer equipment caused by virus or other computer infection. It is the website user’s responsibility to implement all measures to protect his own data and / or hardware and / or software. FEDORA or its partners mentioned on this website cannot be held responsible for any reason whatsoever, for any incident or direct or indirect damage or for any financial or commercial loss, resulting from using of this website.

5.2 Copyright and intellectual property

FEDORA owns the intellectual property rights and the right to use all the items available on the website, including text, images, graphics, logos, icons, sounds and software. Any reproduction, representation, modification, publication, adaptation of all or some elements of the website, regardless of the means or process, is prohibited without prior written permission of FEDORA.

5.3. Jurisdictional allocation

Any litigation related hereto will be examined according to the French law and will be brought to geographically competent courts. The usage of this website constitutes the express consent of the user to the application of this clause of jurisdiction allocation.
